Terms of Service Cloud Server This is a legal agreement between Pho Tue Technology and Software Solutions Joint Stock Company, member companies, and affiliated brands (‘Pho Tue SoftWare Solutions JSC’, ‘we’) and each of our customers (‘You’, ‘You’, ‘Customer’) when using Cloud Server services.

We may amend these Terms of Service at any time; except in urgent cases, we will provide Notification to you at least 10 business days in advance via Email regarding any amendments.
When using Cloud Server services at Pho Tue SoftWare Solutions JSC, you must understand, agree to, and accept the binding conditions of the following Agreement, together withthe general terms for hosting servicesincluding without limitation.

1. Regulation on Software installation support:

1.1.We support Software installation on your Cloud Server at Pho Tue SoftWare Solutions JSC under the following conditions:

• The operating systems and software we support installing are listed atSection 5andSection 6(content at the bottom of this page).
• For copyrighted Dashboards (Control Panel) such as cPanel, Plesk, DirectAdmin: You must provide a License Key, or Pho Tue SoftWare Solutions JSC will provide the License Key and charge according to the Price list. Our technical team will activate it immediately upon initial installation on the Server for you.
• Software is only installed on servers at Pho Tue SoftWare Solutions JSC.

1.2.We only provide Email Server software that is built into the control panel: cPanel, Plesk, DirectAdmin, VestaCP,…..

1.3.Our Cloud Server server services are designed primarily for website operations, not for Email use. You understand and agree that, although Email Server software can operate on your server, it is certainly not feature-optimized and will have many limits on Send/Receive traffic, and cannot guarantee uninterrupted Email transactions. If you need to use Email, you can refer to and register for our Email services.

1.4.To prevent Spam Email exploitation from malicious Software, Virus, … and to prevent Server IP ranges from being listed on the blacklists (Blacklist) of reputable Anti-spam Organizations, All Cloud Server instances at Pho Tue SoftWare Solutions JSC are strictly required to block PORT 25 (SMTP connection Port), including both TCP and UDP. If you need to use SMTP, you may use other SMTP connection Ports such as 26, 465, 587.

1.5.For software License Keys purchased from Pho Tue SoftWare Solutions JSC, we only provide activation support and resolve related technical issues if the software is installed on a server hosted with Pho Tue SoftWare Solutions JSC. For servers hosted elsewhere, Pho Tue SoftWare Solutions JSC is unable to assist.

1.6.We support initial Operating system and Software installation Free of charge. After the Cloud Server Handover to the Customer, if there is a request for a clean reinstallation of the Operating system and Software (Reload OS), Pho Tue SoftWare Solutions JSC will charge an additional fee for each reinstallation of the Control Panel or custom applications.

Note: DirectAdmin, Plesk, and cPanel license keys are usually activated and issued by the vendor within 24 hours, and no later than 72 hours.

2. Regulations on data migration support:

2.1.We migrate website data to the Cloud Server free of chargebundled with the Premium Support planat Pho Tue Software Solutions JSC.

2.2.If you need Data migration for one (or more) website(s) to the Cloud Server at Pho Tue SoftWare Solutions JSC, you need to Register for the Website migration solution to request our technical team to execute it. Our technical team will only execute it under the following conditions:

• Data migration is only performed once you have completed the Order to register for the Website migration solution.
• Only the website's data is migrated, comprising its files, folders, and databases.

2.3.Except for websites hosted at Pho Tue SoftWare Solutions JSC, we will not proceed Backup or data storage as requested for data migration. To ensure that none of your data is lost while stored with a third party, we request that you back up your data stored with the third party yourself and provide us with a download link (link download) to a pre-compressed backup copy containing all files, folders, databases, … before proceeding with data migration.

2.4.We only perform Data migration for you on the condition that the Capacity after migration does not exceed 80% of the total Capacity used across the entire Server. You should carefully consider and calculate Server resources before requesting us to proceed, as Pho Tue SoftWare Solutions JSC may refuse Data migration for you if the new Server Capacity is insufficient to accommodate Storage and system operation.

2.5.You agree that We shall bear no Legal liability for any delays occurring to the Website solution related to data conversion. We cannot guarantee timeframe expediency during the Data migration process as it depends on external factors such as: Link, data size, Server performance, etc.

2.6.Pho Tue Software Solutions JSC accepts no liability of any kind for information leakage, corruption, or data loss during a data migration.

2.7.You agree not to perform any changes or Updates to the Website throughout the process of our Data migration.

2.8.We do not guarantee 100% of your website configuration after data migration because we cannot deeply intervene in the source code, cannot fully understand the website source code structure, and do not specialize in programming. Therefore, we will endeavor to provide flexible support within our expertise; you should coordinate with your website technician to carry out this task quickly.

Note:

• We only assist with migrating data from another provider or another hosting location to a Cloud Server at Pho Tue SoftWare Solutions JSC on condition that the customer supplies a download link to a compressed backup containing all files, directories and databases. By providing that download link to Pho Tue SoftWare Solutions JSC engineers, the customer authorizes them to carry out the migration, and Pho Tue SoftWare Solutions JSC accepts no responsibility whatsoever for information disclosure or for errors caused by missing data after the migration.
• In the event of an upgrade, Cloud Server plan conversion, or Operating system reinstallation (Reload OS), if you can perform your own data migration without any assistance from us, we can support maintaining the operation of the old server for up to 3 days to give you additional time and planning to perform your data migration.

3. Outside the scope of support:

3.1.We do not install operating systems or software outside the supported list in Sections 5 and 6 (at the end of this page).

3.2.To protect customer privacy and data security, we do not SSH or Remote Desktop into the customer's Cloud Server where the customer is on the Basic Support plan.

3.3.We do not perform data migration for a Cloud Server without a Premium Support plan, because we cannot access the inside of the server to carry it out.

3.4.We cannot make deep programming changes to fix errors in a website's source code (errors not caused by the server).

3.5.We cannot intervene in or resolve faults caused by user action (or by malware/viruses) during use that damage or slow down the Cloud Server system.

3.6.We do not intervene in or resolve errors arising from server resource overload that fails to meet the usage demands of websites and applications that Customer is running on the server. We will advise and recommend that Customer upgrade resources or upgrade to a higher plan to adequately support the operation of Customer's websites, applications, and Cloud Server systems.

3.7.We do not take on requests to research or integrate a solution that is not fully supported or that falls outside the experience of the Pho Tue SoftWare Solutions JSC technical team.

3.8.Pho Tue SoftWare Solutions JSC does not have a plan downgrade policy, only an upgrade policy. Therefore, if you need to use a lower service plan, you must follow the procedure to cancel the old plan and register a new service plan suitable for you. Pho Tue SoftWare Solutions JSC will support reinstalling a new server with a completely newly provisioned IP address and handover the server to you. You must perform this data migration yourself within 3 days from the server handover to you; after 3 days, Pho Tue SoftWare Solutions JSC will reclaim the old server and assume no responsibility for the data.

3.9.We do not intervene in or remediate faults arising in services such as Apache/Nginx, Email Server, MySQL, SQL Server, FTP Server, SSH, etc. for Cloud Server plans that do not include the Premium Support Add-on.

3.10.We do not install or configure SSL for websites inside a Cloud Server on the Basic Support plan. We only provide guidance so the customer can do it themselves.

3.11.Sending and receiving email on a Cloud Server is not guaranteed. Pho Tue SoftWare Solutions JSC recommends that customers use the Professional Email service for email workloads.

3.12.We do not provide individual backups for each website's data on the server). Customers can back up their own website data periodically via the Control Panel, from FTP/SFTP client programs, or from the backup services offered by Pho Tue SoftWare Solutions JSC.

3.13.Temporary capacity increases and server downgrades are not supported.

3.14.No intervention or handling is provided for violations of the Pho Tue SoftWare Solutions JSC service agreement.

4. Limits applying to Cloud Server systems:

You are fully entitled to use 100% of the resources provided to you by Pho Tue SoftWare Solutions JSC depending on each Cloud Server plan that you have registered and used. The following is the server resource allocation table according to the Cloud Server service plans

5. Operating systems with pre-installed Control Panel support:

Note: You can install the Control Panel yourself or send a request for Pho Tue SoftWare Solutions JSC technical staff to install it for you.

6. List of optional operating systems (without integrated Control Panel):

In addition to the list of Operating systems and Software with integrated Control Panels, we also provide a list of popular Operating systems widely used by Users for you to Select from. For this list, we provide Servers with the Operating system only.
